Bunroy Holiday Lodges Conditions of Hire

i) The Hirer agrees that the lodges are to be used for a holiday and accepts Section 12(2) and paragraph 8 of Schedule 4 of the Housing (Scotland) Act 1988 applies, ie. : the let is “a tenancy the purpose of which is to confer on the tenant the right to occupy the house for a holiday”.

ii) The Hirer shall not sub-let the premises or any part thereof.

iii) The number of people occupying the premises shall not exceed the number stated in the booking confirmation.

iv) The period of let is from Saturday to Saturday (unless otherwise agreed). The premises will normally be available from 16:00 on the day of arrival and should be vacated by 10:00 on the day of departure.

v) Every care must be taken of the property and its contents and all incidents of loss or damage must be reported immediately.

vi) All fixtures, fittings and equipment must be used solely for their intended purpose.

vii) You and all members of your holiday rental party agree both to keep the property clean and tidy during your holiday and to leave the property in a similar condition as you found it on your arrival.

viii) Pets, where permitted and agreed in advance, must be kept under control at all times. Dogs must be on a lead at all times whilst on the premises and exercised off the site. Dogs must not be left unattended in the property at any time or allowed on any furnishings, beds etc.

ix) The Hirer undertakes to prevent any members of his party from causing a nuisance or disturbance to other residents or occupiers.

x) You are responsible to the Owners for the cost of any breakage or damage in or to the property – along with any additional costs that may result – which are caused by you and/or any members of your holiday rental party, and the Owner can require payment from you to cover any such costs.

xi) In the event of a booking being cancelled the deposit will be forfeit. Where cancellation is within 15 to 28 days before the date of entry 50% of the of the hire cost will be payable and within 8 to 14 days 75% will be payable. The full cost of the rental will be payable for cancellations within the week before or during the rental.

xii) The Owner is entitled at his/her sole and absolute discretion to refuse to hand over to you, or to repossess, the property (which includes the fixtures, fittings, furnishings and decorations) if the Owner reasonably believes that any damage is likely to be caused, has been caused or is being caused by you or any members of your holiday rental party. These circumstances will be treated as a cancellation by you. No refund of any monies you have paid in respect of your booking will be made and the Owner will have no liability or obligation to you as a result of this situation arising.

xiii) The Owner shall have no liability for any death or personal injury to you and/or any members of your holiday rental party however caused.

xiv) The Owner, his agents and employees accept no responsibility for loss, injury or damage to you and/or any members of your holiday rental party or their property howsoever caused arising in any manner out of the let of the premises.
